The construction company had initially received approval from the metropolitan city to build a 12-story tower including two underground floors. Later, after completing further procedures and obtaining approval for the building plan (naksaa), the company received permission to build a 19-story tower. The company has reportedly paid more than NPR 23 million as fees related to the building plan.
The court noted that the company is working according to the legally obtained building plan and deemed it appropriate to allow the continuation of construction as per the agreement. The court also ordered Kathmandu Metropolitan City not to implement or issue any further construction stop notices such as the one issued on Magh 9.
This dispute is linked to tensions between Mayor Shah and former Chief Administrative Officer Saroj Guragai. After Guragai approved the 19-story plan, Mayor Shah accused him of corruption, initiating an investigation and suspending him. This conflict also resulted in the metropolitan city’s budget being halted.
With the court’s order, the construction company now has a legal path to continue building the View Tower. The court has also directed the opposing Kathmandu Metropolitan City to submit a written response within 15 days.
