Ministry Releases Draft E-Commerce Guidelines 2082

The Ministry of Industry, Commerce, and Supplies has issued the draft ‘E-Commerce Guidelines, 2082’ to make online trade transparent, secure, and consumer friendly. Stakeholders and the public have seven days to submit feedback.

The Ministry of Industry, Commerce, and Supplies has published the draft ‘E-Commerce Guidelines, 2082’ with the aim of regulating online businesses and ensuring compliance with legal provisions. The guidelines, prepared under the authority of Section 37 of the E-Commerce Act, 2081, seek to bring all online trade within a transparent and legally compliant framework. The ministry has invited feedback from stakeholders and the general public within seven days to refine the draft before its finalization.

Under the draft guidelines, all e-commerce businesses are required to register on the ministry’s official portal. As per Section 5 of the Act, the department must issue a registration number within seven days if all required details are complete. If the submission is incomplete, the department will inform the applicant and issue the registration number within seven days of receiving all necessary details. Businesses must also update their registration within seven days in case of any changes to outlets, firm name, address, ownership, shareholding structure, or the nature of business.

Firms, companies, or institutions wishing to operate e-commerce platforms must submit a registration application to the department. The application should include the firm registration certificate, permission to issue electronic bills or invoices (if applicable), domain ownership or hosting agreement, privacy and return policies, and a system testing report in accordance with cybersecurity standards.

The draft guidelines provide a 35-day window for existing e-commerce firms without registration to complete their listing once the guidelines are enforced. Firms operating without registration after this period may face inspections, mandatory registration orders within seven days, and potential platform cancellation. Registration may also be revoked if a firm submits false or misleading information, requests deregistration voluntarily, or fails to comply with requirements despite due notice and hearing.

Before finalizing the guidelines, the ministry is actively collecting opinions and suggestions from stakeholders. Feedback can be sent within seven days to [email protected].
