Supreme Court Issues Interim Order Halting Asset Investigation Commission’s Work

The Supreme Court has issued an interim order directing the Asset Investigation Commission to halt all asset investigations.

The Supreme Court, through a single bench of Justice Nripadhwaj Niroula, issued an interim order on Wednesday. This order stops the Asset Investigation Commission from demanding anyone’s property details or moving forward with any investigation work. This pause will remain until the full bench make a final decision on the writ petition. The order came because the commission had published a notice that went against a previous Supreme Court directive.

The court’s decision followed separate writ petitions filed by Former Judges’ Forum Nepal and advocate M.R. Upadhyay.

According to Arjun Prasad Koirala, spokesperson for the Supreme Court, the commission has been ordered not to continue its work immediately. The full written order is still awaited.

Previously, on Ashar 26, a joint bench of Justices Tek Prasad Dhungana and Shrikant Poudel had also issued an interim order. That order stated that no one should be forced to submit asset details, any investigation of submitted details should be kept in status quo, and no legal action should be recommended against anyone until the full bench finalized the writ petition.

However, the commission published a notice on Ashar 29, which was completely against the court’s earlier order. As a result, a contempt of court petition has been filed in the Supreme Court. The petition is against the commission’s chairman, Rajendra Kumar Bhandari, its members Purushottam Parajuli, Chandiraj Dhakal, Ganesh KC, Prakash Lamsal, and the Asset Commission itself. The hearing for this petition is scheduled for Ashar 32.
